Terms governing use of Rheo websites and services.

Mobile app store compliance

Rheo provides tools to author, test, and deliver in-app onboarding experiences. The Services are not designed or licensed for use as a means to evade, bypass, or undermine Apple App Store Review Guidelines, Google Play Developer Program Policies, or similar platform rules.

You are solely responsible for how you integrate Rheo into your applications and for obtaining any consents, disclosures, and approvals required by app stores and applicable law. Misuse of the Services to violate platform policies is prohibited under the Acceptable use section below.

Agreement to terms

These Terms and Conditions ("Terms") govern your access to and use of Rheo websites, applications, APIs, SDKs, and related services (collectively, the "Services") operated by Rheo ("Rheo," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms on behalf of yourself or the organization you represent.

If you are using the Services on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity.

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

Subscriptions and fees

Paid plans, usage limits, and billing cycles are described on our pricing page or in an order form. Fees are non-refundable except where required by law or expressly stated in writing. We may change prices with reasonable notice for renewal terms.

Failure to pay may result in suspension or termination of access. Taxes are your responsibility unless we state otherwise.

You must use the correct environment credentials for each deployment (for example, live publishable keys and channels for production end-user traffic). Misrepresenting usage, circumventing plan limits or metered billing, or otherwise evading fees is prohibited and may be treated as fraudulent use.

Acceptable use

You agree not to, and not to permit others to:

  • Use the Services in violation of applicable law or third-party rights.
  • Upload or transmit malware, abusive content, or unlawful material through the Services.
  • Attempt to probe, scan, or compromise the security or integrity of the Services.
  • Reverse engineer the Services except where such restriction is prohibited by law.
  • Resell or sublicense the Services except as expressly permitted in writing.
  • Use the Services to send spam or deceptive communications to end users.
  • Engage in fraudulent, deceptive, or abusive use of the Services, including misusing credentials, falsifying usage, or attempting to avoid applicable fees or usage limits.
  • Use the Services to circumvent or undermine mobile app store policies, review processes, or platform guidelines.

Fraud monitoring and enforcement

We monitor use of the Services for signs of fraud, abuse, and billing integrity violations. This may include reviewing account activity, API and SDK traffic patterns, usage metrics, subscription and payment history, and other technical or operational signals, whether collected automatically or identified through investigation.

If we reasonably believe that you or your workspace has engaged in fraudulent or abusive conduct, we may take action without prior notice, including suspending or terminating your account or access to the Services, revoking or rotating credentials, blocking ingestion or API access, and pursuing any other remedies available to us under these Terms or applicable law.

We reserve the right to terminate any account we flag as fraudulent, in our sole discretion. Termination for fraud does not entitle you to a refund of fees already paid, and we may report suspected unlawful activity to appropriate authorities where we deem it appropriate.

Your content and end users

You retain ownership of flows, assets, data, and other content you submit to the Services ("Customer Content"). You grant Rheo a limited license to host, process, and display Customer Content solely to provide and improve the Services.

You are solely responsible for your mobile applications, privacy notices, consents, and compliance obligations relating to data you collect from end users through the Services.

Intellectual property

Rheo and its licensors own the Services, including software, documentation, trademarks, and visual design, subject to any rights expressly granted to you. These Terms do not transfer ownership of Rheo intellectual property to you.

Confidentiality and beta features

Non-public information about the Services marked confidential or that a reasonable person would understand to be confidential must not be disclosed without permission. Beta or preview features may be incomplete, change without notice, and are provided "as is."

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR REQUIREMENTS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RHEO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO RHEO FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS IF YOU HAVE NOT PAID FEES.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

Indemnification

You will defend and indemnify Rheo against claims arising from your Customer Content, your applications, or your violation of these Terms or applicable law, except to the extent caused by Rheo's gross negligence or willful misconduct.

Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay fees, if we flag your account for fraudulent or abusive use as described in the Fraud monitoring and enforcement section, or if continued provision poses risk to the Services or others. Upon termination, your right to use the Services ends, but provisions that by nature should survive will remain in effect.

General

These Terms constitute the entire agreement between you and Rheo regarding the Services and supersede prior agreements on the same subject. We may modify these Terms by posting an updated version; continued use after changes become effective constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.
